Late last month, the Center for Medicare and Medicaid Services launched a new program to help consumers identify nursing homes that have a been issued abuse citations. The program uses a new icon to flag nursing homes that are a part of the Medicare compare tool that have been cited for abuse.
In Ohio, there are 960 nursing homes. According to the website, approximately 5% of those nursing homes were flagged by the new program. That means 48 nursing homes in Ohio were flagged the last time we ran our report.
What Does the Icon Look Like?
The new icon that is on CMS’s website flagging nursing homes that have recently been issued citations looks like the following:
The icon is the little red circle with the hand in the STOP signal that will appear under the nursing homes name.
The goal of utilizing the icon is to help people identify nursing homes that have been flagged for abuse that would otherwise only be found through researching inspection reports, lawsuits, and complaints. This should help consumers determine which nursing homes are safe and unsafe for their loved ones.
The nursing home compare tool on Medicare.gov allows consumers to research and compare nursing homes to make an informed decision. There is the nursing home’s name and contact information. It then has a star system to describe the overall rating, health inspection ratings, staffing, and quality measures. Medicare and CMS have now added the small hand motioning STOP surrounded by a red circle.

Criticisms of the New Changes
While most groups are supportive of these changes to the Medicare website, there are also criticisms that it is not enough. Once the nursing home has corrected the issues they were flagged for, the warning will go away. The problem with this is if the nursing home “corrects” the issue, consumers could potentially be unaware of the issues in the first place.
The new system is also vague as to how the problems were corrected. The nursing home consumer is unaware of how the issue was fixed– if it was fixed at all. This is important to people whose loved ones are living and requiring care at the facility. They want to know if there was an issue, how the nursing home staff and its administration have corrected the issues.
What Constitutes an Abuse Citation?
According to CMS’s website, a nursing home will be flagged in order to alert consumers to recent harm to residents’ due to abuse or if they have the potential for harm or abuse of residents.
The citations will be updated on a monthly basis, in order to prevent punishment of facilities that correct what they were cited for. According to Medicare.gov, abuse is defined as the following:
Abuse is defined as the willful infliction of injury, unreasonable confinement, intimidation, or punishment with resulting physical harm, pain or mental anguish. It includes verbal abuse, sexual abuse, physical abuse, and mental abuse.
CMS is hoping that this will help consumers by flagging nursing homes and care facilities that are providing substandard care to residents.
What To Do if Your Loved One’s Nursing Home Has Been Flagged?
If you see that your loved one’s nursing home has been flagged with this new icon it is extremely important that you take the appropriate steps to ensure your loved one is being properly cared for. You should immediately check in with your loved one. Look for signs of abuse or neglect.
- Unexplained bruises, especially on arms or face
- Cuts, abrasions, bruises, or burns suggesting physical trauma
- Poor hygiene, including being unclean, or smelling bad
- Unexplained and unplanned weight loss
- Bedsores, pressure ulcers, or open wounds
- Caregivers trying to isolate, silence, or intimidate residents when family are present 9to prevent them from hearing about abuse)
- Sudden withdrawal from social interaction, such as not talking, participating in events they previously enjoyed, or other withdrawal
- Sudden confusion or depression
- Caregiver verbally belittling or yelling at the elder resident
- Bruising, tearing, or other trauma to the genitals
It is completely possible that there is a reasonable explanation for some of these. But if you observe changes in your loved one’s personality, physical health, or behavior, ask questions and demand answers. It’s the facility’s job to answer your concerns regarding your loved one’s safety and proper care at their facility.
